Ending a tenancy

If you wish to end a tenancy, you need to give 4 full weeks’ notice. Do this by completing the tenancy termination form below. Once notice has been given, it cannot be withdrawn.

If there is more than one name on your tenancy agreement and notice is given by one of the tenants, the tenancy will end for all tenants involved. If you have a flexible tenancy notice must be given by each of the tenants named on the agreement.

Where a tenant is entering permanent residential care but lacks capacity to make a decision about ending their tenancy, they are legally unable to do so. The law is very clear that only certain people may end the tenancy on their behalf. Family and friends may not end the tenancy, nor may a social worker. Only the following people can legally end a tenancy on behalf of a person who lacks mental capacity -

  • someone with Lasting or Enduring Power of Attorney
  • a Deputy appointed by the Court of Protection
