2023 to 2024 Article 4 direction public consultation

Public consultation is being undertaken. It is on proposals to adopt Article 4 Directions for buildings on the Hull Local Heritage List. The aim of the proposal is to introduce specific planning permission requirements. They are to conserve the heritage significance of entries on the list.

What is an Article 4 Direction

An Article 4 Direction is a planning tool. The council can introduce it to withdraw or alter Permitted Development rights within the General Permitted Development Order (GDPO). For example, within a Conservation Area, the GDPO allows for a resident to change the colour of property. However, an Article 4 Direction could be introduced to need planning permission to paint outside a specific colour scheme.

What entries on the list will be included

The Article Directions is targeted at buildings and structures outside of Conservation Areas. This is unless it is considered that extra permitted development rights would be good for their management. It will include -

  • current entries
  • entries which are being processed
  • future proposals

The Article 4 Direction will exclude sites, where alternative measures such as Tree Preservation Order will be more relevant for these entries, and archaeological sites.

What Article 4 Directions are being proposed

  • change of use. This would introduce a need for planning permission to change between class uses with the GDPO
  • demolition. This is to introduce a need for full or substantial demolition of a building or structure
  • external alteration - for all or some of the following requirements -
    • adding to roof levels
    • external cladding
    • an extension to a front or principal elevation
    • an extension to a side elevation
    • change of windows
    • alterations to a shop front
    • alterations to a public frontage
    • the change of roof materials

Given the variety of buildings on the list, the Article 4 would include all relevant Class Orders.

It is not intended that the introduction of Article 4 directions will stop planning permission from being granted for these types of work. It is intended that these measures will allow entries on the list to be conserved and retained on the list.

Public consultations

Before adopting the changes, the council is undertaking a period of public consultation. This will take place between the 15 December 2023 and the 30 January 2024.

Letters will be issued to the registered owners and occupiers of individual buildings and structures affected by the proposals.

Public meeting

As part of the Public Consultation, a public meeting will be held at the Guildhall -

  • 10am to 11.30am and 12 midday to 4pm

Adoption process

After completing the public consultation period, the council will review all feedback received. The council then considers the appropriateness of going forward with an Article 4 Direction proposal. Notification of adopted changes will be made in due course.
