Council Tax and Freeman on the land

The 'Freeman on the Land' movement and similar groups, commonly believe that they are bound only by statute laws they consent to.

We sometimes receive correspondence from residents referring to the following acts -

  • Companies Act
  • Contracts Act
  • Bill of Exchange Act
  • other relevant acts

They state that Council Tax is a contract and requires signatures, which indicates an agreement between parties. This is incorrect and not relevant.

The liability to pay Council Tax falls under the Local Government Finance Act 1992 and later regulations.

This is a statute created by a democratically elected Parliament of the United Kingdom which has received the assent of the Crown.

It is not contractual and does not require a signed agreement or consent.

Any assertion to the contrary is incorrect and there is no legal basis upon which to make this argument.

  • being a ‘freeman on the land’ does not exempt anyone from paying Council Tax.
  • Council Tax is not optional and not something that requires consent.
  • if you are liable to pay Council Tax, you must make your payments.
