Demolition - control and advice

The local authority needs to be told of the demolition of buildings, or parts of a building, over a certain size. This needs to happen before the demolition commences on site.

When the owner of a building over 1750ft³, which is approximately 50m³, intends to have it demolished, Sections 80-83 of the Building Act 1984 require that formal notification be given to Building Control. This must be at least 6-weeks before any demolition work starts.

This is to let all appropriate people and organisations to know of the proposed demolition. It is to make sure that measures to protect the public and to preserve public amenities are put in place.

The notice issued should state the building it relates to. This is as well as what the work of demolition is intended to be carried out. Copies of the notice should be given to the occupiers of any adjacent buildings and the relevant utility companies -

  • gas
  • electricity
  • water

as appropriate. It will help us to process the application. This is if a site plan is also provided, and all relevant contact details included.

You need to give at least 6-weeks notification before the start of demolition. We will write back to you as soon as possible. This is to notify you of your obligations under the Act. Once you have received such notification, you can start the demolition works. Otherwise, you should wait until the 6-weeks has elapsed.

It is an offence to demolish a building without the necessary notice being given.

  • a letter or email should be sent by either the contractor or the building owner. It should notify us of their intention to demolish
  • they should complete the Initial request form questions 1 to 5 and return it at the same time as the below
  • a detailed and clear plan showing the exact location of the demolition works
  • also attached should be a method statement, if they have one. Or it could be sent at a later date

Once all the information has been received, we then start the 6-week process.
