Challenge your Penalty Charge Notice

If your case is at the Bailiff, contact them directly, or contact the Traffic Enforcement Centre on 0300 123 1059 or 01604 619 450. Quote your PCN reference number.

You can appeal your penalty charge notice within 28-days of issue if you feel your parking charge notice -

• has been issued incorrectly
• you did not own the vehicle at the time

What you will need

When submitting your challenge, you must include -

• the date the PCN was issued
• where the PCN was issued
• the make of your vehicle
• the model of your vehicle
• the colour of your vehicle
• the PCN reference number (begins with KH)
• the vehicles registration
• a return address for us to respond to you

If you have lost your PCN number, you should include as much of the above as possible.

If you have lost your PCN, or not received one

Write to the CPE Team explaining your situation and supply as much information as possible to help to trace your case. Include the -

• vehicle registration number
• date, time, and location where the vehicle was parked

The CPE Team will -

• put the PCN on hold whilst they consider your circumstances
• normally write to you within 14-working days

The CPE Team can, if circumstances permit, offer you another discount period. This will be explained in their letter.

Update of the challenge you submitted

If you have not received a letter confirming the outcome of your appeal after 28-days, write to us using the above address. You must include all of the details specified in 'What you will need'.

What happens next

If your challenge is -

• accepted, we will cancel the PCN and confirm this in writing
• rejected an Informal Notice of Rejection will be issued, you will have 14 days from the date of our reply to pay the reduced charge

If payment is not received within 28 days of the date the PCN was issued, we will send a Notice to Owner to the registered keeper of the vehicle. 

If your informal challenge is rejected and the PCN remains unpaid, we will send a Notice to Owner (NtO) to the registered keeper.

You have 28 days from the date you receive the Notice to Owner to make formal representation.

You must - 

• explain your reasons for challenging the PCN in as much detail as possible
• provide copies of any supporting evidence

If your formal representation is accepted, you will not have to pay the PCN. We will confirm our decision in writing.

If your representation is rejected, we will send you a Notice of Rejection. This will explain how to -

• pay the PCN within 28 days, or
• appeal to the Traffic Penalty Tribunal

The Traffic Penalty Tribunal is independent and makes the final decision.

We will include the appeal information with the Notice of Rejection. You cannot appeal to the tribunal unless you have received a Notice of Rejection.

If you have received a Notice to Owner but have no knowledge of a PCN

Complete the Notice to Owner form above and state that you were not aware of the PCN. If you believe the PCN was issued incorrectly, you should also use the opportunity to appeal against the PCN.

If you have received a Charge Certificate, then it is normally too late for you to challenge the PCN. This is explained in detail on the Charge Certificate. 

If you have received a Notice of Rejection and disagree with the decision, you can appeal to the Traffic Penalty Tribunal.

You must submit your appeal within 28 days of the Notice of Rejection being served.

If the Traffic Penalty Tribunal -

• accept and allow your appeal, The PCN will be cancelled
• dismiss your appeal, you will have 28 days to pay the PCN before the PCN escalates to charge certificate. The full penalty will be payable, and the discounted rate will not apply

If the PCN is not paid within 28 days of the Notice to Owner, we may issue a Charge Certificate.

This will -

• increase the charge by 50%
• remove your right to appeal to us

If the Charge Certificate is not paid within 21 days.

You will then be sent an Order for Recovery (OFR), which incurs a further £10 debt registration. You may make a statutory declaration to the Traffic Enforcement Centre on the grounds listed on the OFR.

If no payment or declaration is made, the case may be passed to an enforcement agent who will recover the debt this will incur further fees.

It is now too late to appeal your penalty charge notice.

You can only make an application to the traffic enforcement centre to file a late statutory declaration in the following circumstances -

• that you did not receive a Notice to Owner
• you returned a Notice to Owner to the Council contesting the penalty charge notice, but received no reply
• having returned the Notice to Owner the council rejected your appeal, and you appealed to the Traffic Penalty Tribunal, but received no reply.
